Acceptable Use Policy

By using any service or website provided by Unwired Ltd. (“Unwired”), you agree to the terms of this Acceptable Use Policy. “You” refers to both the account holder and any users of the service.

This Acceptable Use Policy (AUP) is part of your Service Agreement. Violations may result in suspension or termination of your account. Unwired may update this AUP or related terms at any time. Please review it periodically for changes.
 
To the fullest extent allowed by law, Unwired disclaims all warranties—express or implied—regarding the use of its services, systems, or the Internet, including fitness for a particular purpose and non-infringement. We are not responsible for the accuracy or usefulness of any accessed content. Unwired is not liable for any indirect, special, or consequential damages, including loss of data, profits, or service. Failure to enforce any part of this AUP does not waive Unwired’s rights.
 
Lawful Use
You must use Unwired services in accordance with this AUP, your Service Agreement, and all applicable laws and regulations.
 

User Conduct and Prohibited Use
To ensure fair and reliable service for all users, Unwired prohibits any use that is unlawful or that disrupts, degrades, or interferes with our network or other users’ access. Prohibited activities include, but are not limited to:

  • Gaining unauthorized access to any Unwired system, network, account, or data, or attempting to probe, scan, or test for vulnerabilities.
  • Using Unwired services to violate the terms of any other network or internet  service provider.
  • Engaging in fraudulent activity, including phishing, impersonating others, forging digital or manual signatures, or altering email headers, domain names, or IP packet information to conceal sender or recipient identity.
  • Intentionally overloading the network or interfering with service, including spamming, flooding, or distributing viruses, worms, or other malicious software.
  • Collecting email addresses, screen names, or other identifiers in bulk without consent.
  • Using or distributing tools intended to compromise security, such as password crackers, decoders, or unauthorized port scanners.
  • Using or distributing spyware.
  • Posting, storing, or distributing content that is unlawful, threatening, abusive, harassing, libelous, defamatory, obscene, deceptive, fraudulent, invasive of privacy, tortious, indecent, or pornographic.
  • Infringing on the intellectual property rights of any individual or organization.
  • Participating in pyramid schemes or any other illegal financial activities.
  • Engaging in any activity that negatively affects Unwired or its network, including overloading servers, causing IP blocks, or generating excessive complaints that create an unreasonable administrative burden.
Note: Sending unsolicited or deceptive bulk email may violate federal and state laws, including the CAN-SPAM Act, the Computer Fraud and Abuse Act, and other applicable statutes. Violators may face civil and criminal penalties.
 
Network Management and Policy Enforcement
Unwired uses a range of evolving tools and techniques to manage its network and ensure compliance with this Acceptable Use Policy (AUP) and the Service Agreement. These tools may be updated as needed to maintain service quality and network integrity.
 
Violations of this AUP are taken seriously. If, in Unwired’s sole discretion, a violation is suspected, we may remove content, suspend or terminate service, or take other appropriate action. We reserve the right to investigate, which may include reviewing customer data, contacting involved parties, and examining relevant content or activity on our systems.
 
By using the service, you consent to Unwired cooperating with law enforcement or regulatory agencies where required to comply with legal obligations, respond to valid requests, or protect the rights, safety, and operations of Unwired, its employees, customers, or others.
 
Unwired and its affiliates, vendors, and agents are not liable for any costs related to investigating or responding to AUP violations. We may also take further legal or technical measures to protect our network and services.
 
Reporting Obligations
Customers are responsible for promptly reporting any issue that may affect the stability, performance, or security of Unwired’s network or users.
 
Resellers and Downstream Users
Customers who resell or share Unwired services must inform their users of this AUP and ensure compliance. Violations by downstream users will be treated as violations by the account holder.
 
International Use
Unwired makes no representation that materials available on this site or through any Unwired service, are appropriate or available for use in locations outside the United States, and accessing them from territories where their contents are illegal is prohibited.
 
Those who access this site or any site hosted by Unwired from other locations are responsible for compliance with local law.
 
Intellectual Property Rights
All content, designs, and trademarks on Unwired websites or services are the property of Unwired Ltd. and are protected by intellectual property laws. This includes copyrights, trademarks, trade secrets, and other proprietary rights.
You may not use Unwired’s names, logos, or content without prior written permission. Displaying or accessing Unwired materials does not grant any license or rights.
 
If you use Unwired hosting services, you must not use domain names or content that infringe on the rights of any third party.

DMCA Infringement
If you believe your copyrighted work has been used in violation of U.S. copyright law, you may submit a DMCA notice to Unwired. In accordance with the law, we will forward such notices to the appropriate customer.

Unwired reserves the right to terminate service for repeat copyright infringement. If you receive a DMCA notice, follow the instructions provided to respond or file a counter-notification as permitted by law.

Unwired is not a party to copyright disputes and assumes no responsibility for resolving them.

General Complaints
To report a violation of this Acceptable Use Policy, email abuse@unwired.com. Unwired will investigate reports and may require customers to resolve any vulnerabilities or take corrective action. Service may be suspended or terminated for violations.

Unwired cooperates with law enforcement in cases involving suspected criminal
activity. Violators may be subject to civil or criminal penalties.
 
 
 

Network Integrity Policies

Burstability: Service plans offered by Unwired are burstable in nature and not intended to support sustained maximum throughput. If a Customer’s average usage is sustained at the maximum throughput, it may negatively affect overall network performance for other users. In such cases, Unwired may request that the Customer reduce their sustained usage or upgrade to a higher-capacity service plan. If sustained overuse results in network degradation, Unwired reserves the right to apply bandwidth limitations without prior notice to preserve service quality
across the network.
 
File Sharing and Digital Media Usage: Certain applications and devices may attempt to utilize all available bandwidth, leading to network congestion and reduced performance for other users. To help maintain service quality, Unwired requires that such applications and devices be configured to prevent excessive or sustained bandwidth usage. If network performance is negatively impacted, Unwired reserves the right to apply bandwidth restrictions without prior notice to protect overall network integrity.
 
Optimal Network Performance: Customers are expected to follow reasonable usage practices when operating bandwidth-intensive applications or devices. These include:
  • Configuring applications to limit sustained upload and download activity where possible
  • Avoiding simultaneous large file transfers during peak usage periods
  • Scheduling backups, downloads, and updates during off-peak hours
  • Minimizing the use of peer-to-peer file sharing unless properly configured to avoid excessive bandwidth consumption
  • Adherence to these practices helps preserve overall service quality and network integrity.
